Notice on clarifying relevant measures for the management of imported yachts

Municipal and county transport bureaus, competent commercial departments, all subordinate to the customs and branch maritime administrative agencies:

According to the Regulations on the Promotion of the Yacht Industry of Hainan Free Trade Port, it is clear that the relevant measures for the management of the imported yachts with the age of less than 5 years (including) are hereby notified as follows.

1. Scope of imported yachts

(1) According to the Notice of the Customs Tariff Commission of The State Council on the 2022 Tariff Adjustment Plan (Tax Commission (2021) No. 18), the scope of the applicable tariff items in this Notice is: Inflatable boats (including rigid shell) (89031100, 89031200, 89031900), sailing boats (other than inflatable boats, whether or not equipped with auxiliary engines) (89032100, 89032200, 89032300), motor boats (non-inflatable, Except those equipped with outboard engines) (89033100, 89033200, 89033300), other (89039300, 89039900).

Ii. Identification of the age of the ship

(2) For yachts that need to obtain an import license, the age of the yacht refers to the years from the date of completion stated in the technical data (certificate of the builder or certificate of the ship survey issued by the builder) to the date of issuance of the import license.

(3) For yachts that do not need to obtain an import license, the age of the vessel refers to the number of years from the date of completion stated in the technical data (the certificate of construction issued by the builder or the certificate of inspection of the ship) to the date of import (the date of import recorded in the customs declaration).

Where the certificate of construction issued by the construction plant does not indicate the specific date of completion, the date of issuance of the certificate of construction plant shall prevail.

Iii. Scope of import license administration for mechanical and electrical products

(4) the import entity shall be determined by a "single window" in international trade or commerce business system unified platform (https://ecomp.mofcom.gov.cn/) apply for the business.

(5) The application for import of the commodity code of 8903310000, 8903320010, 8903320090, 8903330010, 8903330090, 8903990010 imported yachts, shall meet the requirements of the "Import License Management Goods Catalogue" jointly published by the Ministry of Commerce and the General Administration of Customs. 4. Administration of customs clearance procedures, initial inspection and initial registration

(6) Import yacht enterprises shall go through import customs clearance procedures at Hainan port.

(7) Imported yachts shall apply to the Hainan Branch of China Classification Society for initial inspection.

(8) Imported yachts shall complete initial registration or filing in Hainan.

V. Others

(9) The imported yachts enjoying the "zero tariff" policy shall comply with the Notice of the General Administration of Taxation of the General Administration of Customs of the Ministry of Finance on the "Zero tariff" Policy of Transport vehicles and yachts in Hainan Free Trade Port (Fiscal Tariff (2020) No. 54), and the "Hainan Free Trade Port" Zero Tariff "Import vehicles and yachts Management Measures (Trial)" (Qiongfu (2020) No. 60 "Hainan Free Trade Port transport and yacht" zero tariff "policy Customs implementation Measures (Trial) (General Administration of Customs Announcement 2021 No. 1) and other relevant provisions.

(10) If laws and regulations have provisions on the import, inspection and registration, use and operation of yachts, such provisions shall be followed.
